These Terms of Service (“Terms”) form an agreement between Farcasts (“Farcasts”, “we”, “us”) and the company or person using the service (“you”, “Customer”). By accessing or using the Farcasts platform, or by accepting an order or subscription that references these Terms, you agree to them. If you are agreeing on behalf of an organisation, you confirm you have the authority to bind it.

Farcasts is an AI platform that adapts a company’s website to different visitor types and continuously tests which version converts best. The service generates on-brand website variants, serves them to visitors, and measures results so the best-performing versions can be promoted over time. Features may evolve as we improve the platform.

You must provide accurate account information and keep it current. You are responsible for activity under your account and for keeping your credentials secure. The service is intended for business use by organisations and the people who represent them, and is not directed to individuals under the age of 18.

The service can connect to advertising and other third-party accounts you authorise. When you connect an account, you represent that you have the right to connect it and to grant Farcasts read access to the data it contains. Farcasts acts on your instructions and reads that data only to provide the service to you.

Access granted to Farcasts is read-only. We do not create, modify, pause, or delete anything in a connected account. You may disconnect any account at any time through Farcasts or in the platform’s own settings, and doing so ends our access to it.

You agree not to:

• use the service to break the law or infringe the rights of others;
• upload or generate content that is unlawful, deceptive, or that you do not have the right to use;
• probe, disrupt, or attempt to gain unauthorised access to the platform or its infrastructure;
• resell or provide the service to third parties except as expressly permitted in your order.

Farcasts owns the platform, its software, models, and all related intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the service during your subscription.

You retain ownership of your content, brand, and the data you connect. You grant us the limited licence needed to host, process, and use that material to provide and improve the service for you, including to generate the website variants the service produces.

You are responsible for the content and brand materials you provide, and for the accuracy of any guardrails you set. The service generates variants within the guidance you give it, and you remain responsible for reviewing and approving what goes live on your website. We will act on your instructions to adjust, pause, or remove generated content.

Fees, if any, are as agreed in an order or subscription. Unless stated otherwise, fees are exclusive of taxes and are non-refundable except where required by law. We will let you know in advance of any change to your fees.

Each party may receive information the other treats as confidential. Each party will use the other’s confidential information only to perform under these Terms, protect it with reasonable care, and not disclose it except to people who need it and who are bound by similar obligations. This does not apply to information that is public through no fault of the receiving party or that must be disclosed by law.

We provide the service with reasonable skill and care. Beyond that, and to the extent permitted by law, the service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted or error-free, or that any particular conversion outcome will be achieved.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue. Each party’s total liability arising out of or relating to these Terms is limited to the amounts you paid for the service in the twelve months before the event giving rise to the claim.

You will defend and indemnify Farcasts against claims arising from your content, your use of the service in breach of these Terms, or your lack of rights to connect an account or grant the access you granted. We will defend and indemnify you against claims that the platform, as provided by us, infringes a third party’s intellectual property rights.

These Terms apply for as long as you use the service or as set out in your order. Either party may terminate for material breach that is not cured within a reasonable period. On termination, your right to use the service ends, connected accounts are disconnected, and we will delete or return your data in accordance with our privacy policy and applicable law. Terms that by their nature should survive, such as confidentiality and limitation of liability, continue after termination.

These Terms are governed by the laws of the jurisdiction in which Farcasts is established, without regard to conflict-of-laws rules. The courts of that jurisdiction have exclusive authority over any dispute, unless applicable law provides otherwise.

We may update these Terms from time to time. When we do, we will revise the date at the top and, where changes are material, take reasonable steps to let you know. Continuing to use the service after a change takes effect means you accept the updated Terms.
